Standard Terms of Service

These are the standard terms of service for any design project. Please read them carefully, and if anything seems like a potential problem, let me know before starting so we can discuss any modifications that may be necessary for your particular project.

Pay

Advances, Final Payments and Delivery

The contracted work will begin once the client has delivered all the requested content and paid the 50% deposit; the remaining 50% will be paid upon delivery of the finished product. The deposit will cover the costs of administrative work, meetings, proposals, and initial design work; therefore, it will not be refunded in the event of withdrawal or dissatisfaction. By paying the deposit, the client accepts the terms specified in this document.
The values described in each commercial proposal are valid only for the quantities and characteristics specified therein. The values and specifications will be valid for up to 30 calendar days from the date of issue.
Mauricio Concha reserves the right to withhold delivery until full payment has been received.
Any payment plans other than the one mentioned here must be agreed upon in writing by both parties. Mauricio Concha reserves the right to charge fees incurred in connection with initiating collection and recovery processes for accounts that remain unpaid for more than 30 days.
By paying the remaining balance, the contractor agrees to receive the contracted products and/or services to their satisfaction, with no missing items or outstanding items to be performed.

Time

Delivery Times

The delivery times stipulated in the financial proposals are estimated reference times, based on previous experience with other projects. They vary depending on each particular case and will depend on factors such as communication speed, delivery of inputs, number of corrections to be made, unforeseen events, among others.

Non-communication policy

If a design proposal has been submitted and the client has not submitted corrections or observations within 30 days of said submission, it is understood that the work has been accepted and received to the satisfaction of the client, and the remaining balance and outstanding payments will be collected for the official completion of the project.

Corrections

Every client is entitled to a maximum of three correction sessions for each individual assignment; 5% of the total price of the assignment will be charged for each additional individual correction. If the client has not used all the correction sessions before paying the final balance and thus receiving the product or service to their satisfaction, they will be deemed to have waived the remaining correction sessions.

Corrections Session

A correction session is the process in which the client communicates to the designer the necessary modifications to the submitted proposals in order to meet the established objectives. This process involves compiling all the observations made by the client and their team, which are submitted in a single document. These observations will be sent to Mauricio Concha via email or other means previously agreed upon by the parties. The corrections will then be made one by one. The process concludes with the delivery of a corrected version of the work, leading to a new correction session if necessary.

Ownership and Copyright

The client refrains from using/modifying/altering/replicating or borrowing any of the ideas/concepts/sketches presented as preliminary options. All original preparation materials, sketches, visual elements, and unused ideas presented as preliminary options remain the property of Mauricio Concha, who is free to use them for future conceptual work and for other clients.
Unless otherwise agreed, Mauricio Concha reserves the right to display the associated designs in its portfolio/digital assets/display cases/exhibits, as well as in printed literature, including books and magazines, now and in the future. Associated designs and illustrations may include commercial print design, business cards, stationery design, signs, desktop icons, mobile phone icons and images, and other handheld applications.
All illustrations or supporting designs required for each project may be used by Mauricio Concha for personal and professional purposes.
The final artwork/digital files will become the property of the client only after full payment for the project has been made. The client has the right to adapt, modify, and use the purchased design with complete autonomy, which releases Mauricio Concha from all liability.
Documents such as quotes, forms, questionnaires, reports, presentations, and preliminary proposals constitute the intellectual property of Mauricio Concha and are addressed personally and confidentially to the recipient(s) indicated in each case. Mauricio Concha has the exclusive right to dispose of them, and therefore expressly prohibits the recipient(s) from: reproducing them in whole or in part; communicating, disseminating, or distributing them to third parties; and translating, arranging, and adapting them, regardless of the means used. The disclosure of confidential information without Mauricio Concha's written authorization constitutes unfair conduct that violates the right protected by Article 16 of Law 256 of 1996.
If the client has any specific confidentiality or trade secret requirements, they must be expressly notified in writing to Mauricio Concha before accepting each proposal.
It is the client's responsibility to ensure that the content, text, images, videos, audio, and any other materials delivered to Mauricio Concha for the performance of the work, whether audited by the client, have been expressly authorized for use, or are royalty-free. Any copyright infringement will be the client's sole responsibility. Likewise, Mauricio Concha undertakes to use royalty-free or self-created content for the client's use.

Trademark and Copyright

The costs, procedures, and advice arising from trademark and copyright registration are the responsibility of each client.

Brand Name

The client assumes full responsibility for the freedom of use or availability of the company or product name prior to the commencement of work. Mauricio Concha is exempt from all liability should any legal issues arise related to the name, trademark, visual identity, or corporate identity used by the client.
If you need to change legal information, change the name of your company or product, or make a significant change to content mid-project that requires restarting the process or generating additional work hours, the fee must be recalculated, and a corresponding increase in the final payment must be mutually agreed upon.

Font and Typeface Licenses

All fonts/typefaces used in the final logo and/or supporting brand identity assets are subject to commercial licensing laws. Information on the typefaces used and where they can be purchased will be provided in the concept presentation. It is the client's responsibility to acquire the necessary licenses (paid or unpaid), and please consider this when approving designs. If a copy of a typeface or font is intended for commercial use, the client must acquire the appropriate license and register it in their name. Generally, it is not necessary to license a typeface used in a logo, as the graphics are converted to vector artwork and can no longer be edited. However, if you need a font to use in your own artwork for editorial purposes, such as on a website or in a printed presentation, you will need to license it separately by purchasing a desktop license.

Confidentiality Agreement

Mauricio Concha, aware of the responsibility that comes with handling commercial information for the client, undertakes that the information and documentation related to the project will be handled exclusively by the parties and ultimately delivered in its entirety to the client. By accepting each proposal, the client agrees to treat it in the same way it treats its own confidential information and to not allow its use by unauthorized persons.
